VoxPop Privacy Policy

This Privacy Policy explains how VoxPop LLC ("VoxPop," "we," "us," or "our") collects, uses, shares, and protects personal information when you use the VoxPop Platform, including our websites, applications, account systems, Wallet, and voting features. It is incorporated into and forms part of the Voter and Backer Terms of Service. By using the Platform, you agree to this Policy.
1. Scope and Eligibility
1.1 Who We Are. VoxPop LLC is a New York limited liability company operating a crowd-powered cinema platform. This Policy applies to users, voters, and backers of the Platform. Separate privacy terms may apply to filmmakers and business partners under their agreements.
1.2 Age. The Platform is intended for users who are at least eighteen (18) years old and located in the United States. We do not knowingly collect personal information from anyone under 18.
2. Information We Collect
2.1 Information You Provide. Account and profile information (such as name, email address, and password), Wallet and voting activity, communications you send us, and any content you post, such as comments or reviews.
2.2 Payment Information. When you purchase Credits, payment is processed by our third-party payment processor (such as Stripe). We do not store full payment-card numbers; we receive limited transaction information such as confirmation, partial card details, and billing status.
2.3 Automatically Collected Information. Device and usage data such as IP address, browser and device type, pages viewed, referring URLs, and interaction data, collected through cookies and similar technologies (see Section 5).
2.4 Information from Third Parties. We may receive information from our payment processor, analytics providers, fraud-prevention services, and, if you choose to connect them, third-party sign-in providers.
3. How We Use Information
We use personal information to: operate and secure the Platform and your account; process Credit purchases, Wallet balances, votes, and returns; prevent, detect, and investigate fraud, abuse, and violations of our terms; provide customer support; communicate with you about your account, projects you support, and service updates; personalize and improve the Platform; comply with legal, tax, accounting, and regulatory obligations; and, where permitted, send marketing communications you can opt out of.
4. Payment Processing
4.1 Processors. Credit purchases and filmmaker payouts are handled by third-party payment processors, including Stripe. Their handling of your information is governed by their own terms and privacy practices. We use processors' fraud, chargeback, and failed-payment rules to administer Wallets and Credits.
5. Cookies and Similar Technologies
5.1 Use. We use cookies, pixels, and similar technologies to keep you signed in, remember preferences, measure and analyze usage, secure the Platform, and support marketing. You can control cookies through your browser settings; disabling some cookies may affect Platform functionality.
6. How We Share Information
6.1 Service Providers. We share information with vendors who perform services for us --- payment processing, hosting, analytics, fraud prevention, customer support, and communications --- under obligations to protect it and use it only for the services they provide.
6.2 Legal and Safety. We may disclose information to comply with law, respond to lawful requests and legal process, enforce our terms, and protect the rights, property, and safety of VoxPop, our users, and the public.
6.3 Business Transfers. If VoxPop is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
6.4 No Sale of Personal Information. We do not sell your personal information to third parties for their independent marketing purposes.
7. Data Retention
7.1 Retention. We retain personal information for as long as your account is active and as needed to provide the Platform, and thereafter as required to meet legal, tax, accounting, fraud-prevention, dispute-resolution, and recordkeeping obligations.
8. Security
8.1 Safeguards. We use reasonable administrative, technical, and organizational measures designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Your Choices and Rights
9.1 Account and Marketing. You may review and update your account information and opt out of marketing emails at any time. Service and transactional messages are not optional while you maintain an account.
9.2 Access, Correction, and Deletion. Subject to legal limits, you may request access to, correction of, or deletion of your personal information by contacting us. Certain records must be retained for legal and fraud-prevention purposes.
9.3 State Privacy Rights. Residents of California and certain other states may have additional rights, including rights to know, access, correct, delete, and opt out of certain processing, and the right not to be discriminated against for exercising them. 10. Children
10.1 No Users Under 18. The Platform is not directed to, and may not be used by, anyone under 18. If we learn we have collected information from a person under 18, we will delete it.
11. Third-Party Links and Services
11.1 Third Parties. The Platform may link to or integrate third-party services. We are not responsible for their privacy practices, and we encourage you to review their policies.
12. Changes to This Policy
12.1 Updates. We may update this Policy as the Platform, applicable law, and service providers change. Material changes will be posted with a new effective date and, where practicable, emailed to registered users.
